Rezoning of McKee Road Property Back on Table

If at first you don’t succeed …

Once again Timberland 109 LLC is attempting to rezone property along McKee Road in the Ellerslie community to build a ‘Conservation Subdivision”.

This is the second attempt by Timberland to construct a subdivision on the property, which includes over 586 acres.

A previous attempt earlier this year failed in the face of extensive opposition from members of the community and a 3-2 vote among the commissioners. That plan had included the potential for 179 lots and possibly less as developers faced some challenges as part of the property being in a flood plain, that according to Commissioner Bobby Irions. There were also other issues such as soils, rock, and topographic challenges according to Andy Welsh, with the law firm representing Timberland.

A lawsuit filed by Timberland followed and in August an order was issued remanding the case back to the Harris County Commissioners to officially reconsider the rezoning request. It is presumed that action seeks a compromise between the county and Timberland.

Currently remaining A-1 or agricultural zoning, the notice to rezone to R-1 or residential, is scheduled to be on the commission agenda at 7 pm Tuesday, Sept. 15.

The Harris County Commission meetings are held in the Courthouse in Hamilton.
